Heard Mr. D. Thakuria, learned counsel for the applicants and Mr. G. N. Sahewalla, learned Sr. Counsel for the opposite party.
This is an application for vacation of interim order dated 21.12.2018 passed in WP(C) No. 8880/2018 filed by the opposite party.
The related writ petition i.e. WP(C) No. 8880/2018 has been filed by the opposite party against order dated 14.09.2016 passed by the Additional Deputy Commissioner, Kamrup (M) as well as judgment and order of the Assam Board of Revenue dated 04.09.2018.
Matter relates to mutation over land which opposite party claims was granted in his favour by the Circle Officer and affirmed by the Assam Board of Revenue.
After hearing the matter at some length, Court is of the view that it would be more appropriate if the entire writ petition is heard instead of dealing with the interlocutory application.
Respondents in the writ petition have filed counter affidavit to which writ petitioners have filed reply. Therefore, the related writ petition is ready for admission hearing.
In the light of the above, the related writ petition may be heard at the admission stage
