A Selection Board meeting was held on 14.06.2019 for selection of officer for promotion to the rank of Chief Engineer, PWD for the year 2019. From the minutes of the Selection Board meeting, it is seen that the vacancy had arisen due to expiry of the extended period of service of Sri Hiranmoy Sen as Chief Engineer, PWD on 31.03.2019. As per Rule 13 (2) of the Assam Engineering (PWD) Service Rules, 1978 (Service Rules), the zone of consideration is four times the number of vacancies. In the present case, vacancy being one, the zone of consideration comprised of four officers. According to the Selection Board, zone of consideration comprised of the officers at Sl. Nos.3, 4, 5 and 6 which included applicant at Sl. No.6 and opposite party No.9 at Sl. No.3. It was noticed that there was no departmental proceeding either pending or contemplated against any of the officers within the zone of consideration and that they had fulfilled the relevant criteria. It was also noticed that under the aforesaid Rules, the criteria for promotion above the rank of Superintending Engineer is merit-cum-seniority. Selection Board further noted that since the cadre strength was only 6, the 13 point roster would be attracted as per which 5th roster point was earmarked for ST(P), 8th for SC and 14th for ST(H). It was noted that the vacancy in question is roster point No.5. Applicant being the only ST(P) candidate was accordingly selected and recommended for promotion.
