Heard Mr. G.P. Bhowmik, learned Senior Counsel for the applicant/writ petitioner as well as Mr. J. Payeng, learned counsel representing the State respondents.

It is stated by Mr. Bhowmik that despite interim direction passed in favour of the applicant to the effect that he shall not be taken into custody and deported from India, subject to the condition that he shall appear before the Superintendent of Police (Border), Kamrup within 15(fifteen) days, for reasons beyond control the applicant/writ petitioner could not make himself available before the Superintendent of Police (Border), Kamrup within the period prescribed. Hence, the present application seeking further time to appear before the authority concerned.

We have heard the learned counsel for the parties and have also perused the statements and averments made in the present application. On perusal thereof we reiterate our interim order dated 08.04.2019 passed in the related writ petition i.e. WP(C) 2313/2019 and allow the applicant/writ petitioner Nepal Mazumdar to appear before the Superintendent of Police (Border), Kamrup within 10(ten) days from today. The other directions made in the order dated 08.04.2019 shall remain proprio vigore.
