Heard Mr. SK Singha, learned counsel for the accused-petitioner as well as Mr. NK Kalita, learned Additional Public Prosecutor, appearing for the State respondent.

This is an application, filed under Section 439 of the Cr.PC. seeking bail of the accusedpetitioner, namely, Sri Rohit Das @ Biplab Das, in connection with Gorchuk P.S. Case No. 30/2018 registered under Section 381 of the IPC.

Perused the petition as well as the annexures furnished therewith.

The accused-petitioner has been in custody for 57 (fifty seven) days as on date.

Considering the period of detention of the accused-petitioner, his further custodial detention is not considered necessary. That being so, he is granted bail.

Accordingly, the accused-petitioner, named above, shall be released on bail in connection with Gorchuk P.S. Case No. 30/2018 on furnishing bail bond of Rs. 25,000/- with two suitable sureties of the like amount, to the satisfaction of learned Chief Judicial Magistrate, Kamrup (Metro), Guwahati.

The direction for bail is further subject to the conditions that the accused-petitioner:

(a) shall not leave the territorial jurisdiction of Chief Judicial Magistrate, Kamrup (Metro), Guwahati, without prior written permission from him;

¶22

(b) shall not hamper with the investigation, or tamper with the evidence of the case; and

¶23

(c) shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.

The learned Chief Judicial Magistrate, Kamrup (Metro), Guwahati shall be at liberty to put any other conditions deemed fit while releasing the accused-petitioner on bail with a view to ensure his appearance in the court as and when called upon.

The petition stands disposed of accordingly.
