Babul Hussain and 2 Ors. Vs the State of Assam

This is an application, filed under Section 439 Cr.PC, praying for bail of the accused-petitioners, namely, 1) Babul Hussain, 2) Ajir Uddin, and 3) Abdul Wahab, in connection with Bazaricherra PS Case No. 217/2018 under Sections 147/148/149/307/171(F) IPC.

Heard Mr. H.R.A. Choudhury, learned senior counsel for the accused-petitioners as well as Mr. K. Konwar, learned Additional Public Prosecutor for the state respondent. Perused the petition as well as the annexures furnished therewith. On perusal of the contents of the FIR itself, this court is of the view that further custodial detention of the accused-petitioners, beyond 23 days, for the purpose of the investigation of the case, is not necessary, and accordingly, their prayer for bail is allowed.

The accused petitioners are granted bail on their furnishing a bail bond of Rs. 15,000/- each with one suitable surety each of like amount to the satisfaction of the learned Chief Judicial Magistrate, Karimganj.

The bail petition stands disposed of accordingly.
