This is an application, filed under Section 439 Cr.PC, praying for bail of the accused, namely, Sri Phangran Jugli, in connection with Changlang PS Case No. 37/2019, under Sections 302/120(b) Indian Penal Code read with Section 25(1)(A) of the Arms Act.

Heard Mr. K. Lollen, learned counsel for the accused as well as Mr. J. Tsering, learned Additional PP for the state.

Case diary produced has been perused.

From the case diary, it is found that the accused was arrested and under the custody of S.I.T. w.e.f. 25.8.2019 in connection with some other case. The incident in the instant case occurred on 26.8.2019. The materials in the case diary show that the accused was arrested

on suspicion, and in the meantime, he has been in custody for 86 days as on date. In the instant case, the accused is suspected to be involved in the murder alleged in the FIR. He has also found to be a member of the NSCN(R). From the materials in the case diary, it appears to this court that no such material has been collected by the investigating agency necessitating further custodial detention of the accused, beyond 86 days. Therefore, the prayer for bail of the accused is allowed.

The accused is granted bail on furnishing a bail bond of Rs. 50,000/- with two suitable sureties of like amount to the satisfaction of the learned Judicial Magistrate 1st Class, Changlang, A.P., on the following conditions :

(1) The accused shall not leave the territorial jurisdiction of the learned Judicial Magistrate 1st Class, Changlang, A.P., without prior written permission from the said learned court,

(2) The accused shall not hamper with the investigation, or tamper with the evidence of the case, and

¶26

(3) The accused shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.

The bail petition stands disposed of accordingly. Return the case diary.
