Sariful Hussain Vs the State of Assam

By this application under Section 438 Cr.PC, the petitioner, Md. Sariful Hussain has prayed for pre-arrest bail, apprehending arrest in connection with Panigaon P.S. Case No. 49/2018 (GR No. 1228/2018) under Section 419/376 IPC.

Learned Additional Public Prosecutor for the state respondent has submitted that chargesheet, vide C.S. No. 04/2019, dated 31.10.2019 has already been laid by the investigating officer after completion of the investigation of the case.

That being so, if so advised, the petitioner shall approach the learned court below, wherever the case is pending, with appropriate application for bail.

On the other hand, the petitioner has already been availing interim pre-arrest bail, vide order, dated 19.2.2018. That being so, the interim pre-arrest bail granted to him is extended for another 10 (ten) days enabling him to appear before the learned court below to make an application aforesaid.

In the event the petitioner does not appear before the court below within 10 (ten) days, the interim pre-arrest bail granted to him shall automatically stand vacated. With the observation and direction, this petition stands disposed of.
