This is an application made under Section 438 Cr.P.C ., seeking pre-arrest bail by the petitioner, namely, Rupjyoti Talukdar, apprehending arrest in connection with Boko Police Station Case No. 479 of 2019 , registered under Sections 417/376/406/34 of the IPC .

I have perused the petition including the copy of the FIR and the documents annexed therewith.

Heard Mr. S Rana, learned counsel for the petitioner as well as Mr. NJ Dutta, learned Additional Public Prosecutor, appearing for the State of Assam.

Mr. Dutta, learned Additional Public Prosecutor submits that in the instant case, charge-sheet, vide CS No. 326, dated 31-07-2019, has already been laid by the Investigating Police Officer, after completion of investigation of the case.

That being so, the accused-petitioner is directed to approach the learned trial Court with an appropriate application for bail, and if he makes any application for bail, the same be considered and disposed of on its own merit taking into consideration all the relevant factors. On the other hand, the accused-petitioner has been on interim pre-arrest bail, vide order, dated 28-062019.

Mr. Rana, learned counsel for the petitioner submits that the interim pre-arrest bail granted to the accusedpetitioner may be extended for the next 15 days.

Accordingly, accused-petitioner is directed to appear before the learned trail Court within 15 days from today and till his appearance before the learned trail Court, within 15 days from today, the interim prearrest bail granted to the accused-petitioner, vide order dated 28-06-2019, is extended by this order. However, it is made clear that if the accused-petitioner does not appear within the time stipulated, the interim pre-arrest bail granted to him shall automatically stand vacated.

The anticipatory bail application stands disposed of accordingly.
