By filing this petition under Section 438 of the CrPC, the petitioners namely Abdul Jabbar Khan and

Anowarul Hoque Khan have sought for pre-arrest bail in connection with Golakganj P.S. Case No.484/2018 (GR Case No.2207/2019), under Sections 120B/366A/417/342 of the IPC.

Heard learned counsel for both sides and perused the record.

¶18

Although the case diary was called on repeated occasions but the same is not yet produced.

Today Mr. A. Ahmed, learned counsel has entered appearance for and on behalf of the informant and stated that the case is filed due to misunderstanding and he has no objection if bail is granted to the accused/ petitioners.

The FIR indicates that the prime accused in the case is one Rejaul Khan and it is alleged that at the instance of the present petitioners, the girl of the informant was abducted by the accused No.1. The learned counsel for the petitioner has also drawn the attention of the Court that on the earlier occasion also the victim girl fled away with the said Rejaul Khan. But it was settled on the condition that the marriage between the parties will be solemnized.

Taking note of all above, it appears that custodial interrogation of the accused/petitioners are not required.

Accordingly the interim order passed earlier is made absolute.

The pre-arrest bail petition stands disposed of.
