Heard Mr. M U Mahmud, learned counsel for the petitioner and Mr. A Deka, learned Standing counsel, Secondary Education Department for the respondent Nos. 1 to 4.

In the present writ petition, the select list of Post Graduate Teachers dated 06.04.2013 of the Director of Secondary Education, Assam pursuant to the advertisement dated 08.02.2003 with regard to the Post Graduate Teacher in the subject of Assamese in various

Provincialised Higher Secondary Schools of the State is under challenge.

The said issue has already been decided by this Court in the case of Ms. Shewali Kakoti and 28 Others Vs. the State of Assam and 222 Others in WP(C) No.1955/2013 and by judgment and order dated 15.09.2016 passed by another Single Bench of this Court in said WP(C) No.1955/2013, the impugned select list of 06.04.2013 has been upheld dismissing the said WP(C) No.1955/2013 and further, by afflux of time, said decision dated 15.09.2016 has become absolute, as no appeal has been preferred against the said judgment and order dated 15.09.2016 passed in said WP(C) No.1955/2013.

It is also submitted by Mr. Deka, learned Standing counsel that all the 216 nos. of selected candidates, whose names recorded in the Select List of 06.04.2013 have already been appointed as Post Graduate Teacher in various provincialized H.S. Schools of the State.

In that view of the matter, as the select list dated 06.04.2013 impugned in this writ petition has already been upheld by this Court in the judgment and order dated 15.09.2016 passed in WP(C) No.1955/2013, this writ petition being devoid of merit stands dismissed.

The interim observation made earlier by this Court on 02.09.2013, while issuing notice to the respondents in this proceeding stands vacated.
