The present case has been filed by the writ petitioner for a direction to the respondents to pay the petitioner’s pension as per the revised pay under the ROP Rules 2010.

The petitioner retired on 31.11.2006 from the District Industries and Commerce Center, Hailakandi, Assam, where he was working as a Peon.

Today the counsel for the petitioner has submitted a letter dated 08.01.2018 issued by the Senior Accounts Officer, Office of the Accountant General, issued vide memo No.Pen-5/Rev/2010/GPO/AA/356-57 and which is addressed to the Treasury Officer, Cachar ( Silchar) Treasury.

The above letter states that consequent to the revision of pension of the petitioner, the petitioner’s pension has been revised as follows:--

“I) Pension @ Rs.4370/- (Rupees Four Thousand Three Hundred and Seventy) only p.m. w.e.f 01.10.2007 to 31.03.2016 and thereafter Rs. 10840/- (Rupees Ten Thousand Eight Hundred Forty) w.e.f., 01.04.2016 onwards.”

Petitioner’s counsel submits that in view of the letter dated 08.01.2018 issued by the Senior Accounts Officer, a direction should be issued to the Treasury Officer Cachar (Silchar) Treasury, to pay the pension of the petitioner as per the revised pay.

Mr. A Hassan, learned counsel for the A.G office and Mr. A. K. Azad, submit that in view of the letter dated 08.01.2018 issued by the Senior Accounts Officer regarding payment revised pension to the petitioner, the writ petition can be closed, as the Treasury Officer Cachar (Silchar) Treasury shall have to pay the revised pension to the petitioner as per the above letter.

I have heard the learned counsels for the parties.

In view of the letter dated 08.01.2018 issued by the Senior Accounts Officer, the Treasury Officer Cachar (Silchar) Treasury is directed to make

payment of the revised pension to the petitioner as stated in the said letter.

In this regard the petitioner shall furnish a certified copy of this order along with a copy of the letter dated 08.01.2018 issued by the Senior Accounts Officer to the Treasury Officer, Cachar (Silchar) Treasury for payment of the revised pension.

Writ petition is accordingly disposed of.

The letter dated 08.01.2018 issued by the Senior Accounts Officer is made a part of the record and marked as Annexure- X.
