another before the GMDA for issuance of occupancy certificate in terms of the said NOC dated 04.01.2011 for running the hotel business in the aforesaid building. In response to the said two applications the Commissioner, GMC issued a certificate dated 29.07.2015 thereby granting NOC in allowing to run the hotel under the name and style M/S Barak Residency at Hatigaon Road under Ward No. 59/26 bearing House No. 3851 standing in the names of the two sons of the petitioner No. 2. On the other hand, the GMDA vide letter dated 25.06.2015 rejected the prayer for issuance of occupancy certificate of the petitioner No. 2. The ground for rejection as apparent from the said letter dated 25.06.2015 due to non-compoundable deviations in front and rear setbacks along with other parameters. Being aggrieved on such rejection of the said application for issuance of occupancy certificate, the petitioner No. 2 vide his representation dated 12.08.2015 sought for the intervention of the GMDA appellate authority. But till date, the said representation is yet to be disposed of by the GMDA authority. Mr. Das, learned Senior Counsel, submits that the petitioner through his two sons is running the hotel business after obtaining the requisite permissions from the different authorities so required in order to run such type of business. It is also not disputed by Mr. Das that the building was constructed on the basis of the NOC issued in the year 2011 and there were changes within the locality with respect to the width of the roads and other infrastructures carried out by the GMDA/ GMC authorities. Under such circumstances, if there be any deviation, the same can be compounded and the requisite occupancy certificate ought to have been issued by the GMDA. Mr. Das fairly submits that till date, the GMDA authority nor the GMC has caused any hurdle/ obstruction in carrying out the business.
