In the present writ appeal, the admitted fact is that appellant had secured more marks than the last appointed candidate for the post of Bill Clerk/Meter Reader under Scheduled Tribe (Hills) category. This being the position, the learned standing counsel for Assam Power Distribution Company Limited has fairly agreed that the appellant deserves to be appointed on the post of Bill Clerk.
Having regard to the aforesaid, we direct the respondents to appoint the appellant as Bill Clerk under Scheduled Tribe (Hills) category within 10 (ten) days from today.
With the above direction, the appeal is allowed and the impugned order is set aside.
A copy of the order be supplied to the learned standing counsel for the respondents for information and compliance.
