It transpires that due to serious animosity between the parties on earlier occasion petitioner’s side filed an FIR raising allegation against the husband of the informant/Sri Budheswar Konwar that he has burnt fire to their house causing serious loss to the properties. The present FIR reflects about the earlier incident that said Sri Budheswar Konwar was caught hold by the accused petitioners for setting fire on their house and he was assaulted by chappal etc. He himself has not stated about any sort of serious injury on his person. It reflects nothing to attract offence U/S 364 IPC nor any grievous injury is complaint off by the victim himself. In view of the above it transpires that custodial interrogation of the accused petitioners is unwarranted. Accordingly, each of the accused persons is allowed to go on pre-arrest bail, in the event of their arrest, in connection with the aforesaid case, on furnishing bail bond of Rs.20,000/- each with one surety of the like amount to the satisfaction of the arresting authority.
