By this application filed under Section 438 Cr.P.C., the petitioners, namely, 1. Ms. Mirija Begum @ Merijan Begum @ Nunu, 2. Mr. Ismail Haque and 3. Md. Abdul Mazid have prayed for granting anticipatory bail apprehending their arrest in connection with Sipajhar P.S. Case No. 368/2018 under Sections 147/148/149/447/352/326/307 IPC.

The case diary as called for is placed before this court.

Mr. Kamar, learned counsel appearing for the petitioner submits that as per the terms of the interim anticipatory bail granted vide order, dated 15.09.2018, the petitioners have appeared before the I.O.

The case diary reveals that the injuries sustained by the victim are simple in nature and the investigation has substantially progressed and as such, further detention of the accused is not warranted.

Having considered the submissions of the learned counsel for both the sides, and also that the petitioners have appeard before the I.O. in compliance with the order dated 15.09.2018 and further that they are co-operating in the investigation, the interim anticipatory bail granted vide order, dated 15.09.2018, is hereby made absolute, subject to the conditions:-

(a) that the petitioners shall not directly or indirectly, make any inducement, thereat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer; and

¶24

(b) that the petitioners shall not hamper or tamper in investigation.

Return the case diary.

With the above directions, the petition stands disposed of.
