By this application under Section 438 Cr.P.C., the petitioners, namely, 1. Ajit Singnar, 2. Dipak Dey @ Dipak Debnath, and 3. Krishna Debnath, have prayed for granting pre-arrest bail apprehending arrest in connection with Diphu PS Case No.157/2018 under Sections 294-A IPC read with Section 14, 15, 16 and 17 of the Assam Game and Betting Act.

The present petitioners are not named in the FIR, however the allegation against the present petitioners are that they communicate result of the betting through various means to the beneficiaries.

Case diary produced today does not reflect any incriminating materials justifying the necessity of custodial interrogation of the present petitioners. Therefore, it appears to be a fit case for granting the benefit of pre-arrest bail to the petitioners. Accordingly the prayer for pre-arrest bail is allowed.

It is provided that, in the event of arrest of the petitioners in connection with the aforementioned case, the petitioners above named shall be released on furnishing a bail bond of Rs.15,000/- each, with a suitable surety of the like amount to the satisfaction of the arresting authority. The pre-arrest bail is subject to the following conditions.

The petitioners shall appear before the Investigating Officer within 15 days and co-operate with the investigation.

The petitioners shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.

The pre-arrest bail application stands disposed of.
