The case diary reveals that informant in his FIR has made complaint about some irregularities committed by the petitioners, who is the dealer of Silchar Petrol Pump. He said that on various of documents of the dealer some irregularities like excess storing of HSD to the extent of 11.20 per cent were found, which is above the permissible limit of variation of stock for which it is believed to have been involved in malpractices on the part of petitioners. On the other hand, some other irregularities like not displaying the price stock and trading articles in the premises were found and that apart they are stated to have realized higher prices from customers. They are also stated to have not maintained cash memo book properly. Referring to these irregularities it is concluded (in the last portion of the FIR) that petitioners were found to have contravened the provision of clause 2(f)(vii)(v) & (vi) of the MS & HSD (Regulation of supply,Distribution and Prevention of Malpractices,) Order 2005 and the terms and conditions of the Assam Trade Articles (Licencing and Control) Order, 1982.
