This original^{application has been filed by the} applicant^{bank, on tz.Ll.z1zlthroughSunilVerma'Chief} Manager of^{the applicant bank, under Section19 of the} RDB Act,^{1993 againstthe defendants for recovery of a} sum of^{Rs.91,71,155.96together with cost''charges and} pendentellite and^{future interest @10'10o/o p'a' from date} of filing^{of this O.A. till the realization in full'}

The^{brief facts of the case are that at the request} of defendant^{no.1 through its proprietor defendantno'2'} the applicant^{bank sanctioned a Term Loan Facility of} Rs.90,00,000 |^{-, videsanction letter dated 06'02' 20 19' To} secure the^{aforesaidfacility, tlTe defendantscreated} hypothecation^{of the stock,tebtors,plant & machinery} c).\

and hypothecation of birds, feeds, machinery.^debtors etc. The defendans executed all necessary^loaning documents on 06.02.2019.

It is fufther submitted that the defendants^enjoyed and utilized the Loan facilities, but^failed to^{maintain the} financial discipline and failed to repay the due^amounts. The applicant bank requested the defendants^to regularize the loan account by^{visits and letters, but there} was no response from the defendants.^{Hence, the} account was classified as^{NPA dated 31'03.2021. The} applicant bank^{served a recall noticedated 06.09.2021to} the defendants but^{failed to recover the sameThus, the} present O.A.ff.A. is^preferred by the^{applicant bank to} recover its dues.

On notice by this^{Tribunal, defendants failed to} put appearance at all, despite^{service. Accordingly, the} defendants were^{proceededagainst expafte on} 05.09.2023.

The applicant bank^{has filed evidenceby way of} affidavit of Shri.^{SunilVerma, ChiefManager of the} applicant bank^{as Annexure A-1 to Annexure A-13, which} have^gone unchallenged^{and un-rebutted.Hence,the} case of the applicant^{stands fully established againstthe} defendants with^{respect to nonpayment of outstanding} amount. ;i:,

After^perusing the^{records, this Tribunalis of} the view that the applicant bank^{has proved its case} beyond reasonable doubts.^{The evidence and documents} filed by the applicant bank not rebutted by^the defendans by not^placing any^{evidenceand thereis no} question of disbelieving the evidence and documents^filed by the applicant bank based upon^{the written/printed} documents.

In the tight of the above discussions,^{the presentT.A.} deserves to be allowed.

I hereby allow this^T.A. of^{the applicant bank and} direct the defendant nos.1^{and 2 to pay jointly and} severally to the applicant bank^{within30 days from today,} a sum of Rs.91,71,155.96 along^{with cost, expenses and} interest @10.10o/o from the date^{of filing of this O.A.} which has become T.A till^{the date of realization.}

In case of failure to deposit^{the aboveamount} within the stipulated^{period,the sameshall be recovered} from the sale of hypothecated^{assets'In case of shott} fall, the same shall be^{recoveredfrom the sale of personal} movable and immovable^{assets of the defendant nos.1} and 2.
