The Original Application is filed by the Applicant Bank against the

The Applicant Bank has filed the present petition i.e., I.A.No.64/2026 with affidavit of the Chief Manager of the applicant bank, Sh. Rajesh Dutt, praying to appoint an Advocate Commissioner to verify the original loan documents pertaining to the vehicle loan lying on the file (Crime / FIR No.201/2019) at the Greater Chennai Police, Central Crime Branch, Bank Fraud Investigation, No.132, Commissioner Office Building, II Floor, EVR Sampath Road, Vepery, Chennai – 600 007 and submit a report before this Tribunal, pending disposal of OA.

It is the case of Applicant Bank that the original documents in Exhibit A14 to A20 are not available with the bank to file before this Tribunal. The first respondent had availed Vehicle and Housing Loan and executed the loan documents in favour of the bank. However, he has not purchased the vehicle as per the terms of the agreement and cheated the bank. Therefore, the petitioner bank lodged the police complaint (Crime / FIR Number 201/2019) before the Greater Chennai Police, Central Crime Branch, Bank Fraud Investigation, No.132, Commissioner Office Building, II Floor, EVR Sampath Road, Vepery, Chennai – 600 007.

It is further submitted by the applicant bank that the original loan documents pertaining to the vehicle loan were filed before CCB Branch, Vepery, Chennai – 7. In view of the above, the said original documents are not available with the bank to file before this Tribunal. The applicant bank had furnish the list of documents Ex A-14 to A-20 in the affidavit.

Therefore, it is prayed to appoint an Advocate Commissioner to verify the

above said original documents and submit the report to this Tribunal.

The defendants remained ex-parte in the OA.

Heard the counsel for applicant bank and perused the records of produced along with the IA.

In the circumstances pleaded, IA No.64/26 stands allowed. Sh. P.M. Surendhar, Advocate (MS 3723/2014), (Mob.9840165259) is appointed as Advocate Commissioner for the above said purpose. The remuneration of Advocate Commissioner for the purpose is fixed at Rs.20,000/- to be paid by applicant bank directly and file proof thereof, apart from incidental expenses incurred by the Advocate Commissioner at the time of execution of warrant. After receiving the remuneration, the Advocate Commissioner is directed to file a memo acknowledging the receipt before this Tribunal.

Upon filing of memo by Advocate Commissioner, Registry is directed to issue warrant to the Advocate Commissioner accordingly along with copy of IA No.64/2026. List the matter on 22.04.2026 for report of the Advocate Commissioner.
