The Original Application is filed by the Applicant Bank against the Defendants, seeking for recovery of money due from Defendants jointly and severally to pay a sum of Rs.94,54,926.82p (Rupees Ninety Four Lakhs Fifty Four Thousand Nine Hundred and Twenty Six and Eighty

Two only) repayable together with further interest and costs.

The Applicant Bank has filed the present petition i.e., I.A.No.2345/2025 with affidavit of the Chief Manager, ROSARB, Chennai of applicant bank, praying to direct the 3^rd respondent / 3^rd defendant within a time to be fixed by the Tribunal, either to furnish security, in such sum as may be specified, failing which grant an Attachment of the petition schedule mentioned properties belonging to the 3^rd defendant, pending disposal of the above OA.

It is the case of applicant bank that the Respondents / Defendants availed Baroda Traders Loan facility of Rs.1,22,32,000/- under floating option at 13.25% with monthly rests i.e. 3.00 % above the Base Rate of 10.25% at the time of sanction repayable in 12 months repayable on demand subject to annual review for their working capital vide Sanction Letter dated 29.03.2014, after executing necessary loan and security documents in favour of applicant bank. For the due repayment of the loan amount, the 3^rd respondent / 3^rd defendant offered his immovable property

as security by depositing the title deeds relating to the schedule mentioned property with the applicant bank.

It is submitted that the respondents neither repaid the loan amounts, except for a few repayments, which was not sufficient for maintaining the loan account. Hence the loan account was declared as NPA on 31.10.2016 and the defendants are due and payable to the applicant bank a sum of Rs.94,54,926.82p together with future interest. Inspite of several demands, defendants did not come forward to repay the dues. Hence the applicant bank had filed the OA No.128/2017, since transferred

to the Tribunal and re-numbered as TA No.940/2023 for recovery of its dues from defendants.

It is further submitted by the applicant bank that the immovable property offered by the 3^rd respondent / 3^rd defendant is not sufficient to cover the outstanding liabilities. On discreet enquiry and on verification of the EC, it is given to understand that the 3^rd respondent / 3^rd defendant is owing immovable properties as detailed in para 6 of the IA, morefully detailed in schedule to the IA.

It is submitted that the schedule “A” property is mortgaged by the 3^rd respondent in favour of Andhra Bank as evidenced by the Memorandum of Deposit of title deeds dated 19.05.2011 bearing Doc. No.2736/2011 executed at SRO, Pallavaram. Schedule “B” and “C” properties are mortgaged by the 3^rd respondent in favour of Canara Bank as evidenced by the Memorandum of Deposit of Title Deeds dated 08.03.2021 bearing Doc.

No.6445/2021 executed at SRO, Kundrathur and that the above charges/encumbrances are still subsisting as no entry regarding satisfaction of the charge is found in the ECs. The above said Memorandum of Deposit of title deeds dated 08.03.2021 bearing Doc. No.6445/2021 executed at SRO, Kundrathur has been executed by Mr. Suresh Kumar and Mrs. Pappa, the 4^th respondent. Mr. Suresh Kumar created mortgaged in favour Canara Bank in respect of schedule “B” and “C” properties herein and Mrs. Pappa also created mortgage in favour Canara Bank in respect of the properties belonging to her.

It is further submitted that Item No. 1 and Item No.2 of the schedule “D” properties are mortgaged by the 3^rd respondent in favour of Indian Overseas Bank as evidenced from the Memorandum of Deposit of title deeds dated 03.05.2011 bearing Doc. No.4072/2011 executed at SRO, Thiruporur. The Item No. 3 to Item No.12 of the schedule “D” properties are mortgaged by the 3rd respondent in favour of Bank of India as evidenced by the Memorandum of Deposit of title deeds dated 15.02.2013 bearing Doc. No.2042/2013 executed at SRO, Thiruporur. The value of the above Schedule “A”, “B”, “C” and “D” properties are about Rs.85 Lakhs.

It is submitted that the petitioner bank unable to take action against the above mortgaged property under SARFAESI Act, since the 3^rd respondent had already created mortgage over the above said property in favour of the State Bank of India for availing loan. Traders and the 1^st respondent had produced the Encumbrance Certificate at the time of availing loan and the same is not reflecting about the earlier mortgage created in favour of M/s. State Bank of India. Therefore, the petitioner bank is unable to recover its dues by way of sale of the mortgaged property due to reasons stated above.

It is submitted that it is given to understand that the 3rd respondent is making attempts to dispose off the petition schedule properties, in order to deprive the Petitioner Bank the fruits of the Recovery Certificate that may ultimately be granted in favour of the Petitioner and the Petitioner may not be in a position to recover the Certificate amount which may ultimately be issued in favour of the Bank. Moreover, the Hypothecation of stocks and book debts are not available since unit was closed and the mortgaged property is not saleable. Now the entire claim amount in the above T.A. is unsecured. Hence the present application is filed praying to direct the 3^rd respondent to furnish security within the time frame fixed by the Tribunal, failing which to grant an order of Attachment before Judgment of the schedule mentioned property belonging to 3^rd respondent, till the disposal of the OA.

The Applicant Bank has filed the above I.A. on the premise that 3^rd respondent may alienate or dispose of or create third-party interest on the property morefully described in the schedule to the IA.

It is a matter of record that the OA was filed for recovery of sum of Rs.94,54,926.82p which is a colossal sum of money. Considering the amount of claim involved in this case and the balance of convenience, the present IA is to be allowed by keeping open the merits of the case and without prejudice to the rights of both the parties. By doing so, no prejudice, no harm and loss will be caused to the Defendants.

As per Section 19 (13)(A) of RDB Act,

“ Where, at any stage of the proceedings, [the Tribunal on an application made by the applicant along with particulars of property to be attached and estimated value thereof, or otherwise] is satisfied that the defendant, with intent to obstruct or delay or frustrate the execution of any order for the recovery of debt that may be passed against him

(i)is about to dispose of the whole or any part of his property; or (ii)is about to remove the whole or any part of the property from the local limits of the jurisdiction of the Tribunal; or

(iii)is likely to cause any damage or mischief to the property or affect its value by misuse or creating third party interest,

the Tribunal may direct the defendant, within a time to be fixed by it, either to furnish security, in such sum as may be specified in the order, to produce and place at the disposal of the Tribunal, when required, the said property or the value of the same, or such portion thereof as may be sufficient to satisfy the certificate for the recovery

of debt, or to appear and show cause why he should not furnish security.

(B)Where the defendant fails to show cause why he should not furnish security, or fails to furnish the security required, within the time fixed by the Tribunal, the Tribunal may order the attachment of the whole or such portion of the properties claimed by the applicant as the properties secured in his favour or otherwise owned by the defendant as appears sufficient to satisfy any certificate for the recovery of debt.”

As the Applicant Bank has prima facie established the essential ingredients for granting an order of temporary injunction restraining the 3^rd respondent in respect of the property mentioned in the schedule to the petition, this Tribunal proceeds to pass the following order:

In the circumstances pleaded, respondents are hereby directed to show cause as to why he should not furnish security to the tune of OA claim in a sum of Rs.94,54,926.82p within 15 days from the date of receipt of this order, failing which to attach the IA schedule mentioned property belonging to 3^rd respondent to answer the OA claim herein.

Meanwhile, conditional attachment of the petition schedule mentioned property to the extent of OA claim of Rs.94,54,926.82p together with further interest is hereby ordered to secure the dues

of the applicant bank, however (i) as second charge of the applicant bank in respect of Schedule A mentioned property belonging to 3^rd respondent, as the Encumbrance Certificate produced by the applicant bank reflects the charge of State Bank of India vide MOD Doc No.2736/2011 dated 19.05.2011 before SRO, Pallavaram;

(ii) as second charge of the applicant bank in respect of Schedule B and C mentioned properties belonging to 3^rd respondent, as the Encumbrance Certificate produced by the applicant bank reflects the charge of Canara Bank vide MOD Doc No.6445/2021 dated 08.03.2021 before SRO, Kundrathur;

(iii) as second charge of the applicant bank in respect of Item Nos.1 and 2 of Schedule D mentioned properties belonging to 3^rd respondent, as the Encumbrance Certificate produced by the applicant bank reflects the charge of Indian Overseas Bank vide MOD Doc No.4072/2011 dated 03.05.2011 before SRO, Thiruporur;

(iv) as second charge of the applicant bank in respect of Item Nos.3 to 12 of Schedule D mentioned properties belonging to 3^rd respondent, as the Encumbrance Certificate produced by the applicant bank reflects the charge of Bank of India vide MOD Doc No.2042/2013 dated 15.02.2013 before SRO, Thiruporur.
