applicant bank sanctioned acredit Facilitiesi.e., (1). Overdraft Facility of Rs.100.00Lakhs for the period of 12 moths and (2). Bank GuaranteeFacility of Rs.100.00 lakhs, vide sanction letterdated 01.08.2016.The aforesaid facilities wereguaranteed through personal guarantees/corporate guarantee of thedefendant nos.2 to 6 and were alsosecured by way of hypothecation of entirestocks of raw materials,wiP, semi-finished and finishedgoods, consumable stores spares including bookdebts, bill whether documentary or clean, outstandingmonies, receivableboth present and future. Tofurthersecure the limits availed by the defendants, the defendantno.2 along with defendant nos.4 and 5 by way ofconstructivedelivery createdor extended a charge ofequitable mortgagedon the immovabteproperties being Plot No.RR-3and RR-4, Khasra No.252,BrindawanGarden, RetreatMagson Colony, VillageDautana, Kosi Kalan, Mathura,Uttar Pradesh andEntire Basement of propefi being J-54, saket, NewDelhi. Boar resolutiondated 01.08.2016 passed by the defendantno.2 company inter-alia authorized defendantno.5 and defendantno.4 to executed thenecessarydocumentsfor credit facilities as availed bythe defendant no.1. The defendantshave executed allnecessary loaning documents on 04.08.2016 and29.07 .20t6.
