This original application^{has been filed by the} applicant bank,^{on 29.06.2021 through Mr' Ramesh} chandra Saini,^{chiefManagerof the applicant bank,} under section^{t9 of the RDB Act, 1993 against the} defendants^{for recovery of a sum of Rs.35,38,538.65} together with^{cost, charges and pendentelliteand} future interest @12.10%^{from date of filing of this O'A'} till the realization^{in full.}

The brief^{facts of the case are that at the request} of the defendant^{no.l throughits director defendant} no.Z, the applicant^{bank sanctioneda WorkingCapital} Loan Facility of^{Rs.25,00,000/-.The defendantno.1} through its^{directorbeing defendantno.2 executed} 5A\

various documents to the effect of^{sanction of} working capital limit on^{05.03.2015.The defendant} nos.2 and 3 stood as^guarantors.

It is further^{submitted that the defendants} enjoyed and utilized^{the Loan facilities,but failed to} maintain the financia!^{discipline and failed to repay the} due amounts. The^{applicant bank requested the} defendants to regularize^{the loan accountby visits and} letters, but there^{was no response from the} defendants, hence^{the account was classifiedas NPA} on 31.12.2018.^{The applicantbank serued a legal} notice dated 24.04.2019^{to the defendants but failed to} recover the same.^{Thus, the present O.A.[I.A'is} preferred by the applicant bank^{to recover its dues.}

documents filed by^{the applicant bank not} rebutted by the defendants^{by not placing any evidence} and there is no^{question of disbelieving the evidence} and documents^{filed by the applicant bank based upon} the written/Printed^documents.

In the light of the^{above discussions, the presentT.A.} deserues to be^allowed.

I hereby^{allow this T.A. of the applicant bank and} direct the defendant^{nos. 1 to 3 to pay jointly and} severally to the^{applicant bank within 30 days from} today, a sum of^{Rs.35,38,538.65along with cost,} expenses and^interest @11^{.75o/o from the date of filing} of this o.A.^{which has become T.A till the date of} realization.

In case of^{failure to depositthe above amount} within the stipulated^{period, the same shall be} recovered from^{the sale of persona! movable and} immovable assets^{of the defendant nos' 1 to 3'}

Recovery^{certificate be issued forthwith and be} sent to Recovery^{officer, Debts Recovery Tribunal-Il,} Delhi.
