This original application has^{been filed by the} applicant banlt on 31.03.2017^{throughShri Alok Kumar,} Assistant Manager of^{the applicant bank, under Section19} of the RDB Act, 1993 against^{the sole defendant for} recovery of a sum of^{Rs.20,76,958.61together with cost,} charges and^{pendentellite and future interest} @^24olo P'a. from date of filing of this O.A. till the^{realization in full.}

The brief facts of the^{case are that at the requestof} the sole defendant, the applicant^{bank sanctioneda} Personal Loan Facility of^{Rs.25,00,000/-for the purpose} of home repair. The^{sole defendant executedall} necessary loaning documents on^13.07.2015.

It is further submitted^{that the defendants enjoyed} and utilized the^{Loan facility, but failed to maintain the} financial discipline and failed to^{repay the due amounts'} The applicant bank requested^{the defendantsto} regularize the loan account blvisits^{and letters, but there} S"t .

On^{notice by this Tribunal, sole defendantput} appearance^{through counsel but failed to file written} statement.^{Thereafter,the sole defendant faited to put} appearance^{inthe matter, despitepublication'} Accordingly,^{the sole defendant was proceededagainst} exparte on^01.04.2025.

The^{applicantbank has filed documentsas} Annexure^{A-1 to Annexure A-4, which have gone} unchallenged^{and un-rebutted'Hence' the case of the} applicant^{stands fully established against the defendants} with respect^{to nonpaymentof outstanding amount'}

After^{perusing the records, this Tribunalis of the} view that^{the applicant bank has provedits case beyond} reasonable^{doubts. The documents filed by the applicant} bank not^{rebutted by the defendantsby not placingany} evidenceandthereisnoquestionofdisbelievingthe documents^{filed by the applicant bank based upon the} written/Printed^documents'
