This original^{application has been filed by the} applicant^{bank, on 01.03'2018 through Mr' Shripad} Dilip Tikaram,^{Assistant General Manager of the} applicant^{bank, under Section 19 of the RDB Act' 1993} against^{the defendantsfor recoveryof a sum of} Rs. 1,1^L,gg ,8L2.24^{together with cost' chargesand} [email protected]/ofromdate of filing^{of this O.A. till the realization in full'}

Again, the at the request of defendant no.1. the applicant bank renewed the Cash Credit Facility of^{Rs.100.00'Lacs,} vide sanction letter dated 18.04.2016.^{Again, at the} request of defendant no.1, the applicant^bank sanctioned a Adhoc Packing Credit^{Limit Facility of} Rs.50.00 Lacs, vide sanction^{letter dated 05.05.2016.} Again, at the request of^{defendant no.1, the applicant} bank sanctioned a Working^{Capital Demand Loan} facility of Rs.6.00 Lacs,^{vide sanction letter dated} 16.03.2017. The defendant^{no.1 has executed all} necessary loaning documents^{on 26.10.2015,} 03.08.2013, 2L.LL.20L4,^06.04.2015, 30. 09. 20¹ 5,07.05.20^{16 and 16.0 3.20L7. The aforesaid} credit facility was^{securedby mortgage of properlY i.e.,} Falt No.406,^{Pavilion Height, Tower-Phase-I,Jaypee} Greens, sector-l28,^{Noida ownedby defendant and} hypothecation of^{entirestock, entire receivableand} other current^{assets of the companyat its showroom,} godown etc. and any other^{place belongingto or may} belong to and^{held as owner/lessee/licenseeby the} borrower^company.

It is^{further submitted that the defendants} enjoyed and^{utilizedthe Loan facilities, but failed to} maintain the^{financial discipline and failed to repay the} due amounts.^{The applicantbank requested the} defendants to^{regularize the loan accountby visits and} letters, but there^{was no response from the} defendants,^{hence the account was classifiedas NPA} on 31. L2.20t7.^{The applicant bank seryed a demand} notice dated^{25.01.2018 to the defendants but failed to} d.

recover the same. Thus, the^{present O.A.fl'.A. is} preferred by the applicant bank to recover its dues.

On notice by this Tribunal, defendants^put appearance through^{counsel but failed to file written} statement. Thereafter, the defendants^{failed to put} appearance in the matter, despite^{issuance of default} notice. Accordingly, the defendants^{were proceeded} against expafte on 12.02.2026.

The applicant bank^{has filed evidenceby way of} affidavit of Shri. Ratnesh^{Kumar Sinha, Chief Manager} of the applicant bank^{as Paper No.25 to Paper No.259,} which have gone unchallenged and^un-rebutted. Hence, the case of the applicant^{stands fully} established against the defendants^{with respect to} nonpayment of outstanding^amount.

After^perusing the^{records, this Tribunalis of the} view that the applicant bank^{has provedits case} beyond reasonable doubts.^{The evidenceand} documents filed by the^{applicantbank not rebuttedby} the defendants by not^{placing any evidenceand there} is no^question of disbelieving^{the evidenceand} documents filed by the^{applicantbank based upon the} written/pri nted docu^ments.

In the light of the above^{discussions, the presentT.A.} deserues to be allowed.

I hereby atlow^{this T.A. of the applicant bank and} direct the defendant^{nos.1 to 3 to pay jointly and} severally to the applicant^{bank within 30 days from} today, a sum of Rs.1,1t,99,8t2.24^{along with cost,}
