In this matter, the respondent bank submitted that it is not possible by the bank to go below Rs. 7.50 Lac for settlement. The applicant is the wife of the borrower and borrower is not making payment. The subject property is her matrimonial home and she is ready and willing to make the payment to the bank. After deliberation it was agreed on Rs. 5.50 Lac and the applicant will pay Rs. 5.50 Lac as full and final settlement within 10 days subject to the bank giving No Dues Certificate.
The applicant submits that all the documents may be returned on subrogation. Let the bank be release the documents to the applicant duly identified by the advocate and copy of ID of the Advocate duly singed kept in the records. The applicant will get the subrogation after deposit of the amount.
In view of the above, this Securitization Application stands disposed of. File be consigned to record, as per rules. Copy of order be uploaded on website.
In case of any exigency, the parties are at liberty to file Misc. Application.
