praying for withdrawal of the main S.A. The application is
supported by Affidavit of the applicant Smt. Lavina lvlurarka.
During the pendency of the S.A. the matter has been
settled with the Respondent Bank and the Respondent Bank is
not going to continue with the instant proceeding and has
issued a'No Dues Certificate'. Since this is an amicable
settlement between the parties and the Applicant intends to
withdraw the main S.A., no prejudice will be caused if the I A. is
allowed without inviting response from other side. Accordingly,
the instant I.A. is allowed and stands disposed of being
dismissed as withdrawn as settled amicably.
S.A. No.676 of 2024 along with all other pending I A.s, if
any, is disposed of as withdrawn.
The respondent bank is darected to return the original
Title Deed to the S.A. applacants, lf lt is not already done, withrn
15 days from the date of thrs order, as per rules.
File be consigned to Record Room after observing all
formalities.
