In this matter, after brief negotiations, the bank submits that they have taken possession from Mr. Ravindra Kumar Sharma. He is paying dues of the bank which after negotiation, has been agreed at Rs. 08.00 Lac. This entire amount has to be paid on or before 15.03.2026, however counsel for the applicant submits that he will make an endeavor to make the payment by 15.03.2026, but order may record the payment date as 25.03.2026.
Counsel for the Suneel Kumar Sharma submits that they have got interest in the property. Be that it may be, since the possession was taken from Shri Ravindra Kumar Sharma, the respondent FI, i.e. Bajaj Housing Finance Ltd shall restore the possession to him only after receiving of agreeable amount of Rs. 8.00 Lac from him and issue No Dues Certificate also.
Both the parties are free to litigate in Civil Court, but for Bajaj Housing Finance Ltd, there shall be no liability.
In view of the above, SA stands dismissed, all pending IAs also stands disposed off, if any.
