Applicant claims to be a tenant has filed this SA and even after recording the applicant is not entitled to get protection, this Tribunal had issued notice to the Respondent to find out how much time can be given to the Applicant to vacate the premises.
Even today when the matter is taken up, no representation for the Applicant. Going by the documents produced by the Applicant, it is seen that the Applicant is claiming to be a tenant, based on an unregistered lease agreement dated 31.01.2025. It is obvious that the said agreement came to the existence after the mortgage. By no stretch of imagination it can be held that the Applicant is entitled to protect his possession if any against the SARFAESI measures.
