The Ld. counsel for respondent bank has submitted that he has already withdrawn the notice issued under section 13 (2) and 13 (a) of the SARFAESI Act against which the present sA has been filed. Therefore, the SA has become infructuous.
The Ld. counsel for sA applicant has submitted that the fresh notice under Section 13 (2) has not been served upon him.
The Ld. counsel for respondent bank is directed to suppty the copy of the fresh demand notice to the Ld. counsel for the applicant. As the notice under section 13 (2) against which the present SA has been preferred has already been withdrawn, therefore, the present sA has become infructuous and is liable to be dismissed as infructuous.
