jurisdiction of this Tribunal because the respondent has initiated mea'sures under Section 13(4) of the SARFAESI Act from its office L2l6-L220, 12thFloor, Naurang House, Plot no. 21, Kasturba Gandhi Road, Connaught Place, New Delhi which falls within the jurisdiction of this Tribunal. From perusal of the possession notice it is clear that the same has not been issued from the above address. The notice under Section 13(2) of the SARFAESI Act has been issued from Mumbal office and the objections under Section 13(3A) of the SARFAESI Act has been sent to the authorized officer Mumbai. The notice under 13(4)has also not been issued from Delhi branch of the respondent FI. There is no evidence that it has been issued from Delhi branch of the respondent FI. The subject property is situated in Kaithal, Haryana and the order under Section 14 of the SARFAESI Acthas been passed by the Ld. DM, Kaithal, Haryana. Therefore, the contention of the applicant that in the orderpassed under Section 14 of the SARFAESI Act, it has been mentioned that the address of the authorized officer is at Delhi and therefore, this Tribunal hasjurisdiction cannot be accepted. Therefore, this Tribunal is of the view that this Tribunal has nojurisdiction to enteftain thepresent SA and the SA is liable to be dismissed on this preliminary ground. The Ld. counsel of the applicant has not claimed that anypaft of actionhas arisen in Delhi and therefore, he has flled thepresent SA in Delhi, therefore, the contention of the applicant has no force.
