building bearing No. 199/12, R.V. Road, II Block, Jayanagar, Bangalore- 560004. It is contended by the applicants that the applicants had acquired the property by virtue or registered partition deed dated 31.08.1999, registered as Document No. BNG(U)-JNR1772/1999-2000 of Book-I, dated 10.11.1999, in the office of the Subregistrar, Jayanagar, Bengaluru Urban District and got Khatha transferred in their name. It is also contended that the applicant had been in the enjoyment of the property and had been paying tax for the same. It is further contended by the applicants that the proceedings initiated by the 1st respondent against the schedule property is unsustainable. It is admitted by the applicants that the respondent No.2 had illegally executed memorandum of entry with respect to entire property wherein the 2nd respondent’s right was limited to ground floor alone and it is also pointed out that based on the above, the first respondent has initiated proceedings under the SARFEASI Act and procured the order dated 24.09.2024 pursuant to which the applicants who are neither the borrowers nor the guarantors are threatened with dispossession of their property which was never secured for the purpose of repayment of any facility with the 1st respondent.
