Ritu Raj and another ( Applicants) have filed this Securitization Application under Section 17 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act. 2002 (SARFAESI Acl). against the Authorized Officer. Punjab National Bank ( Respondent ).

Admittedly. in the year 2010. the Bank had sanctioned a home loan of Rs.12.00 lacs and another home loan of Rs.5.00 lacs to the Applicants. Applicants did not make the repayment. and the Bank declared the account NPA. On 19.12.2024. Bank issued the notice under Section 13(2). On 21.03.2025, Bank issued the notice under Section 13(4). and on 25.03.2025. it issued the notice under Section 13(8). Bank had put up the property for auction vide auction notice dated 18.07.2025. However. the auction fixed for 29.08.2025 failed. Applicants have alleged that they had filed objections on 10.02.2025. which \vere responded by the Bank on 28.05.2025. It is further alleged that the Bank has failed to serve the notice under Section 13(4). Accordingly. the SARFAESI action be set aside.

Mr. Rajneesh Chauhan. counsel for the Applicants. argues that there is no proper CERSAI registration. and since the Bank has failed to prove on record the service of notice under Section 13(4). the SARFAESI action be set aside

Per contra . Mr. Chawla. counsel for the Bank. argues that though the Applicants have alleged that they had filed objections to the notice under Section 13(2) dated 19.12.2024 on 10.02.2025. the fact is that the objections were received by the Bank on 16.05.2025. and the Bank responded to the same on 28.05.2025. Mr. Cha\vIa. submitted that the Applicants have. in fact. antedated the objections. He submitted that there is proper CERSAI registration. There are two properties in this case. He has also drawn my attention to the CERS Al Report (Annexure R-8).

1 have considered the rival contentions.

Having considered the rival contentions. I am of the considered view that there is no merit in the SA. The Bank has produced on the record photographs; proof of service of the notice under Section 13(4) and there is also proper CERSAI registration. AccordingIY. the SA is hereby dismissed. All the pending IAs. if any. are also stand disposed of accordingly.
