amount/instalments, which were due by the bank i.e., of Rs.24,24,146/- and in fact, Sh. Jaswinder Singh is still behind the bar since 2019 due to an FIR lodged against him under Section 420/406 of IPC; that because of this reason, respondent without following the due process of law, initiated proceedings under the Act against the applicant/guarantor for taking possession of the secured asset/residential house of the applicant; that applicant has neither received loan recall notice nor any notice under Section 13(2) & 13(4) of the Act issued by bank; that the in the month of November, 2023 the applicant received possession notice (Letter) dated 09.11.2023 issued by Kanungo by virtue of order of District Magistrate, Patiala, whereby the above said property was being shown to be taken in possession on 28.11.2023 but unfortunately, respondent could not get dispossessed applicant from his residential house; that subsequently, applicant received another possession notice (Letter) dated 29.12.2023 issued by Kanungo, in which Patwari was directed that the possession of the property of the applicant was to be handed over to respondent after taking it from applicant on 12.01.2024; that applicant is having no fault at all as applicant never took any loan amount nor he is liable to repay any amount as he is only guarantor of Sh. Jaswinder Singh; that without making any efforts against Sh. Jaswinder Singh for repay the loan amount, respondent could not take any action against the applicant. Therefore, it was prayed that the present SA may kindly be allowed.
