Further, the valuation of property was obtained by the respondent bank from its registered valuer vide valuation report dated 04.02.2024. The said valuation report has been annexed with counter affidavit annexure – E, page 32–45. Thereafter, property was put on auction sale by issuing auction sale notices dated 14.02.2024, fixing the date of auction sale on 15.03.2024. The sale notice was affixed on secured asset and also sent to the applicant through registered post on 16.02.2024 as evident from the annexure – F series, page – 48-51. But again the respondent bank failed to file its tracking report to prove the service of sale notice upon applicants. However, the sale notice was published in “Hindustan" on 20.2.2024 and “Business Standard" on 27.02.2024. The property was auctioned on 15.03.2024 to the successful bidder, Rajkishor Poddar, for Rs.8.33 lacs. Accordingly, the auction purchaser deposited Rs.1,26,000/– on 16.03.2024 excluding the EMD of Rs.82,300/- deposited on 13.03.2024. Further, Rs.5,00.000/– was deposited on 25.03.2024 and the rest Rs.1,28,700/– was deposited on 28.03.2024. To prove the above said payment, the auction purchaser annexed the copy of the statement of account as annexure – A, page 7-8 of the counter affidavit filed by the auction purchaser. On receipt of the entire auction amount, the respondent bank issued a Sale Certificate dated 28.03.2024 in favour of the auction purchaser and the physical possession of the property was also handed over to the auction purchaser on 19.07.2024 with the assistance of District Administration
