financial papers despite numerous reminders. The account was declared NPA on 28.02.2023 after the Applicant failed to pay the overdue amount despite reminders. Mr. Sidhu, submitted that vide order dated 08.04.2025, the Applicant was permitted to challenge the auction only. However, the Applicant, apart from challenging the sale, has amended other grounds also, which cannot be done. He further argued that Mridul Sharma, proprietor of Hotel Trance, is also the owner of M/s Himachal Gas and Petroleum Company, which was sanctioned a Vyapar term loan of Rs.40.00 lacs vide sanction letter dated 14.12.2021 and Vyapar OD of Rs. 20.00 lacs vide sanction letter dated 14.12.2021. The said loan facilities were also secured by the mortgage of the petrol pump site measuring 1-0-2 bighas situated at Mohal Lachkandi, Tehsil Padhar and District Mandi, and land measuring 0- 14-44 hectare situated at Mohal Sheela, Tehsil and District Kangra. Apart from this, Smt. Shaloo, W/o Mridul Sharma, had also been sanctioned a loan of Rs. 20.00 lacs vide sanction letter dated 24.03.2021 against the security of the property in this case. It is stated that the Applicant failed to maintain financial discipline and was asked to clear the overdue amount to avoid the slippage of the account into NPA. However, without any result, Applicant was also directed to submit the balance sheets and other financial papers for renewal/rescheduling. Bank had issued letters/emails dated 08.02.2022, 09.03.2022, 21.03.2022, 06.05.2022, 11.10.2022, 13.11.2022, 06.02.2022, 12.12.2022, 12.01.2023, 19.01.2023, and 06.02.2023 respectively. It is submitted that in reply to the notice under Section 13(2), Applicant had filed objections on 25.04.2023, which were responded to by the Bank on 02.05.2023. The Bank had taken physical possession on 15.12.2023 on the basis of the order dated 11.09.2023 passed by the DM. Bank had put up the property for auction on 12.02.2024 at the reserve price of Rs.9,41,87,000/-. The sale notice was duly served upon the Applicant
