the Applicant by Regd. post and also published the said notice in two leading newspapers and also affixed on the schedule property. Thereafter, the Bank approached Ld.lV Addl.CMM, Nampally, Hyderabad u/s 14 of the SARFAESI Act, 2OO2 for appointment of advocate commissioner for taking physical possession of the schedule property and the advocate commissioner appointed by the Ld.lV Addl.CMM, Nampally, Hyderabad issued vacate notice to the Applicant and initially, challenging the said vacate notice, the Applicant liled the present SA. After filing of the SA, This Hon'ble Tribunal granted conditional interim order but the Applicant failed to comply with the said order and so, the Bank proceeded further and issued 30 days sale notice dt.O9.O2.2O22 and sent the same to the Applicant through Regd.Post and published the said notice in newspapers and the said notice was also affixed on the schedule property. Before fixing reserve price, the Bank obtained valuation report in respect of the schedule property, however the said auction was not materialized. Again the bank put the schedule property for auction on LO.LO.2O23 and the said auction was also not materialized. Thus the Bank has duly followed the procedure prescribed under the provisions of SARFAESI Act,2OO2 a..d Rules made thereunder and there are no violations. Accordingly, Ld. counsel prayed to dismiss the SA.
