too much before the filing of the present SA; that applicant had never made any honest and bonafide efforts to regularize the account, therefore, loan account of the applicant was classified as NPA on 11.10.2023 much after Covid Pandemic as per Guidelines of the Reserve Bank of India; that thereafter, notice under Section 13(2) of the Act dated 29.07.2024 was issued and was duly served upon applicant as per Rules; that amounts demanded in the said notice were not tendered nor any objections were filed by applicant under Section 13(3-A) of the Act; that applicant was vaguely denying the service of the notice despite being aware of the entire process right since inception; that applicant had availed substantial time and opportunity, however evidently no efforts were made to regularize/repay the loan amount; that applicant intends to shift the blame upon the respondent for her own defaults; that since the dues were not repaid, respondent had issued notice under Section 13(4) of the Act dated 24.12.2024; that despite being aware and in receipt of possession notice, the same was never challenged by the applicant; that action of respondent is in accordance with the provisions of Act; that applicant was aware of the issuance of possession notice and also date of auction, however still no challenge was ever made to the same within the period of limitation; that property in question was sold and the respondent is obligatory to deliver the possession to the Auction purchaser in accordance with Rule 9(9) of Rules read with Section 14 of the Act; that there is no basis or ground in the entire SA, which has been filed only to create hindrance in the recovery process of the respondent. Therefore, it was prayed that the present SA may kindly be dismissed with costs. (5) Replication by applicant was filed to the reply filed by respondent, wherein the contents of SA were reiterated and that of the reply to the SA were denied.
