applicant No.2 - Baljit Singh and Meena Singh, in fact, as per the bank's record there is no partnership between Meena Singh and applicant No.2, as per the bank records its between Baljit Singh and Meena Rani; that from such facts it's clear that the applicants are misleading this Tribunal and the present application is liable to dismissed; that the applicants have taken the false plea that on seeing the advertisement in newspaper on 12.02.2025 applicant No.2 came to know about the auction notice; that in fact, applicants were fully aware about the SARFAESI/recovery proceedings going on in the loan account, as the mortgaged property stands sold in open e-auction after several attempts and applicant No.2 was keenly watching the auction proceedings and upon knowing that the e-auction remain successful this time then applicants had filed the present SA by taking false pleas to challenge the recovery proceedings; that applicant No.2 himself stated that he came to know about e-auction proceedings on 12.02.2025 which was scheduled for 28.02.2025 even then after passing of long time, he filed the SA on 27.03.2025 after the successful result of the e-auction proceedings without disclosing the fact that what are the circumstances which stopped him to approach this Tribunal prior to 28.02.2025; that from these facts, the malafide intentions of the applicants are clear and as they intends to take favourable orders from this Tribunal by taking false pleas; that in para No.5(G) of the application applicants has taken the plea that applicant No.2 shifted to his new address which is not intimated to the respondent as he is under stress and pressure of divorce and on the other hand in para No.5(E) of the application, he is submitting that after divorce of applicant he changed his address and starting residing at the permanent residence as mentioned in the memo of parties, which is self-contradictory statement; that respondent has also filed OA before this Tribunal wherein the address of the applicant No.2 is given as "House No.14, Village, Khuni Majra, Post Office Rasan Heri, Tehsil Kharar, S.A.S. Nagar, (Mohali)" as stated in the memo of parties of this application and applicant No.2 here was duly served as per the tracking report enclosed in the service report dated 18.05.2024 in the OA; that therefore, from these facts it is very much clear that each and every notice have been served upon the applicant
