Present Original Application was instituted by the applicant under Section 19 of the Recovery of Debts and Bankruptcy Act, 1993, against the defendants for recovery of Rs. 56,05,182.30 (Rupees Fifty Six Lacs Five Thousand One Hundred Eighty Two and Paise Thirty Only). The Original Application has been filed through Sh. Rajendra Prasad, Authorized Representative of the applicant, who is competent to institute the Original Application vide Power of Attorney dated 16.10.2021, which is Annexure A1 to this OA.

The brief facts of the OA are that defendant no. 1 approached the applicant for grant of Commercial Loan of Rs. 28.50 Lacs and Rs. 2.00 Lacs vide Loan Application Form dated 26.03.2018, which is Annexure A2 to this OA. Thereafter, defendant no. 1 approached the applicant for grant of Commercial Vehicle of Rs. 21.06 Lacs vide Loan Application Form dated 01.05.2019, which is Annexure A3 to this OA. Loan of Rs. 12.77 Lacs vide Loan Application Form dated 18.06.2019, which is Annexure A4 to this OA. Thereafter, defendant no. 1 approached the applicant for grant of Commercial Loans of Rs.46,22,430.00 Lacs and Rs. 2,11,406.00.

The applicant sanctioned Commercial Loan of Rs. 28,46,125.00 vide Agreement for Loan and Guarantee dated 11.04.2018, which is Annexure A5 to this OA and the terms and conditions were duly accepted by the defendants. Thereafter, applicant sanctioned the Commercial Loan of Rs. 21,33,933.00 vide Agreement for Loan and Guarantee dated 01.05.2019, which is Annexure A6 to this OA. Thereafter, applicant sanctioned the Commercial Loan of Rs.12,93,938.00 vide Agreement for Loan and Guarantee dated 11.07.2019, which is Annexure A7 to this OA. Thereafter, applicant sanctioned the Commercial Loans of Rs. 46,22,430.00 and Rs.2,11,406.00. Defendant no. 2 stood as guarantor in all the loan accounts.

However, as per the Status Affidavit of Sh. Deepak Sharda, Authorized Officer of applicant filed on 23.07.2026, out of 5 loan accounts involved in OA, 1 is active (Loan Account no. 86787223) and 4 loan accounts are closed.

Defendant no. 1 hypothecated his Commercial Vehicle namely Tata LPT 4925 bearing Registration no. RJ21GE0064, Chassis no. MAT774004N1E14978 and Engine no. B6.7B6A250D02122D64211758 vide RC filed on 26.09.2024 in compliance of order dated 02.09.2024. Documents Executed: Irrevocable Power of Attorney, which is Annexure A8 to this OA; Statement of Accounts, which are Annexure A9 to A13 to this OA and Legal Notice dated 13.07.2023 along with postal receipts, which are Annexure A14 to A16 to this OA.

The loan account became irregular and was classified as NPA and after adjusting debit and credit entries in loan account there was a debit of Rs. 56,05,182.30 which is recoverable and the defendants were served recall notice but they did not repay the outstanding amount, therefore, the applicant requested to accept the application and to issue Recovery Certificate accordingly.

The defendants were served summons to appear before this Tribunal but no one appeared on behalf of defendants and they were proceeded ex-parte vide order dated 25.07.2024.

In support of the OA, affidavit of Sh. Rajendra Prasad, Authorized Representative, HDFC Bank Limited has been filed.

Heard ex-parte arguments and perused record.

It was argued by learned counsel (through VC) that in view of the documentary evidence brought on record which had gone unrebutted, the applicant had proved its case.

From the perusal of all the Annexure A1 to A16 to this OA, it is proved that defendant no. 1 approached applicant for availing of the loan facilities which was granted to him. Defendant no. 2 stood as guarantor in all the loan accounts. Defendants had executed all the relevant documents in favour of the applicant. The defendants failed to pay back the loan as per terms and conditions of the agreement between the parties. Subsequently, account of the defendants was classified as NPA. However, as per the Status Affidavit of Sh. Deepak Sharda, Authorized Officer of applicant filed on 23.07.2026, out of 5 loan accounts involved in OA, 1 is active (Loan Account no. 86787223) and 4 loan accounts are closed and there were payments deposited in Commercial Loans I, II, III, IV and V during the pendency of this OA, which is given as under:

In so far as pendente lite and future rate of interest is concerned, the applicant in relief clause has claimed interest @12.01%p.a. from the date of filing of the application till the realization.

The Tribunal is of the considered opinion that sometimes in appropriate cases the prerogative of mercy is the brightest jewel in the crown of the Judge. Keeping in view the facts and circumstances of the

instant case including nature of the hypothecated assets, undertaking of the defendants, quantum of loans and prevalent market rates of interest which have gone drastically downhill in yester years, while exercising the discretion vested in this Tribunal, this Tribunal deems it just and appropriate to grant simple interest @8.00% p.a. in the loan account from the date of filing of the OA till realization of the amount ordered vide this final order. It is ordered accordingly.

In the result, the application is allowed declaring that the defendants are liable to pay to the applicant a total sum of Rs.4,54,223.95 (Rupees Four Lacs Fifty Four Thousand Two Hundred Twenty Three and Paise Ninety Five Only) jointly and severally, with costs, current and future simple interest @8.00% p.a. in the loan account from the date of filing of OA till the date of realization of the amount.

Accordingly, the applicant shall be entitled to recover aforesaid amount from the sale of hypothecated asset of the defendant no. 1 in execution proceedings if not sold earlier under the provisions of the SARFAESI Act, 2002. If the dues of the applicant still remain unsatisfied, it shall be entitled to recover the same by attachment and sale of personal assets of the defendants. The applicant is at liberty to

enforce the claim through due process of law.

12. Any other application pending stands disposed of.

Issue Recovery Certificate accordingly.
