The Applicant Bank filed the present OA for the recovery a total sum of Rs.97,86,212.75 ps i.e., Rs. 90,31,66g.75 ps under term loan account no.5532795450 with future interest @g.90olo and Rs. 7,54,524/- under cash credit account no.56214g1400 with future interest @11.30olo from 19.06.2025 tiil the date of realization along with costs and, in default, sale of OA hypothecated assets.

Summon served on Defendant Nos. 1 to 3 and were set exparte on 26.02.2026 as called absent and no representation.

The Applicant Bank examined Mr. Konduri Shailesh, Manager, as AW-1 and marked 3g documents through him as Ex.A.1 to Ex.A.38.

Heard the arguments of the learned counsel for the applicant.

As stated supra, the Defendants^{remainedex-pade.The} Evidence Affidavit coupled with the^{recitalsin the documents} viz., Exs.A.1 to A.3B^marked on^{behalf of the Applicant Bank} clinches the claim of the^{Applicant Bank against the Defendants.} Hence, I hold that the^{Defendantsare liable to pay the OA claim} to the Applicant^{Bank with futureinterest and costs.}

In the result, the^{present Original Application No.964/2025is} allowed as under:^-

i) The Defendant Nos. 1 to^{3 jointlyand} severally are liable to^{pay to the Applicant} Bank a sum Rs.97,86,212'75^{ps with future} interest @9.35olo simple^{from the date of} application till the^{date of realization;}

ii) the OA claim is secured^{bY way of} hypothecation of assets^{as describedin the} schedule annexed to^{the OA and the} applicant bank is^{entitledto proceed against} the same to realise^{its debt;}

iii) the applicant bank^{is also entitled to proceed} against the^{person and propertiesof} defendants for^{realization of its dues;}
