OA/941/2025 HDFC BANK LIMITED VS. M/S JAP TRADING CO AND ANOTHER the defendants for recovery of Rs.22,44,235.61 (Rupees Twenty Two Lac Forty Four Thousand Two Hundred Thirty Five and Paise Sixty One Only). The Original Application has been filed through Sh. Madhur Sharma, Deputy Vice-President, of the Applicant, who is competent to institute the Original Application vide Board Resolution dated 22.11.2023, which is Annexure A1 to this OA. 2. The brief facts of the OA are that the Defendant no.1, through its proprietor defendant no.2, approached the applicant for grant of CC Limit of Rs.50.00 lacs vide Loan Application, which is Annexure A2 to this OA. 3. The applicant sanctioned the CC Limit of Rs.50.00 lacs vide Sanction Letter dated 19.06.2023, which is Annexure A3 to this OA and terms and conditions were duly accepted by the defendants. 4. Defendant no.1, through its proprietor defendant no.2, hypothecated its stock and book debts vide Deed of Hypothecation dated 19.06.2023, which is Annexure A5 to this OA; Documents executed: Master Facility Agreement dated 19.06.2023, which is Annexure A4 to this OA; Power of Attorney dated 19.06.2023, which is Annexure A6 to this OA; Statement of Account, Calculation Chart and Certificate under the Bankers' Books Evidence Act, 1891 (colly) pertaining to the Cash Credit Account, which is Annexure A7 to this OA; Memoranda of Interest, which is Annexure A8 to this OA; Recall Notice dated 28.05.2025, which is Annexure A9 to this OA. 5. The loan account became irregular and was classified as NPA and after adjusting debit and credit entries in the loan account, there was a debit of Rs.22,44,235.61 (Rupees Twenty Two Lac Forty Four Thousand Two Hundred Thirty Five and Paise Sixty One Only), which is recoverable and the defendants were served recall notices but they did not repay the outstanding amount, therefore, the applicant requested to accept the application and to issue Recovery Certificate accordingly. 6.
