Punjab National Bank has filed this application under Section 19 of the Recovery of Debts and Bankruptcy Act, 1993 (RDB Act) for the recovery of Rs.23,95,468/- with interest against Sh. Gurmel Singh @Gurmail Singh others (defendant).

Bank’s case is that on 27.02.2012, it had granted a loan of Rs.11.00 Lacs to defendant i.e. Sh. Gurmel Singh @Gurmail Singh (since deceased through his LRs’) in the form of O.G.C. Limit for

agricultural purpose. To secure the loan, Defendant Sh. Gurmel Singh @Gurmail Singh (now deceased) had mortgaged his land (fully detailed in para No.3A of the application). The loan was chargeable to interest @8.80% per annum with half-yearly rests. On 10.04.2022, a sum of Rs.23,95,468/- was due from the defendant. Despite repeated requests, defendant did not make the repayment. Hence, this application.

On 01.06.2022, summons was sent to the defendant by registered post, which was duly served. However, defendant did not put in appearance.

During the course of proceedings, IA No.665 of 2023, filed by the applicant bank for impleading the LRs’ of deceased defendant along with amended memo of parties was allowed vide order dated 01.08.2024. LRs’ of the deceased defendants failed to appear before this Tribunal despite serving the summons. Accordingly, vide order dated 17.01.2025, all the defendants were proceeded ex parte .

In order to prove its case, the Bank has placed on record the affidavit of Sh. Sandeep Kumar, Branch Manager along with the loan and security documents and marked them as Exhibit A-1 to A-8. 5. I have perused the evidence on the record. I am of the considered view that the Bank has proved its case that it had advanced the loan of Rs.11.00 Lacs and on 10.04.2022, a sum of Rs.23,95,468/- was due. 6. Accordingly, the application of the bank for the recovery of Rs.23,95,468/- (Rupees Twenty Three Lacs Ninety Five Thousand Four Hundred Sixty Eight Only) with interest @8.80% per annum with halfyearly rests from 02.05.2022, till the date of payment is hereby allowed with costs. The liability of LRs’ of the deceased defendant would be limited upto the extent of the property(ies) inherited by them from Sh.

Gurmel Singh @Gurmail Singh (now deceased). Bank can recover its dues by the sale of mortgaged land fully detailed in para No.3A of the application as well as from the movable and immovable property(ies) inherited by the LRs’ from Sh. Gurmel Singh @Gurmail Singh (now deceased).

Pending IAs, if any, stand disposed of.

Recovery Certificate be issued accordingly.

Party is directed to appear before Recovery Officer on 26.02.2026, who is directed to distribute the sale proceeds of the mortgaged land and standing crops as per the provisions of Section 19(20-AB) of the Act .

A Copy of this order along with Recovery Certificate be sent to the Recovery Officer as well as the party.
