Canara Bank has filed this application under Section 19 of the Recovery of Debts and Bankruptcy Act, 1993 (RDB Act) for the recovery of ₹28,28,080.10p with interest against Sh. Supreet Singh (defendant).

Bank’s case is that on 23.07.2020, it had granted a loan of ₹15.00 Lacs to the defendant in the form of K.C.C Limit for agricultural purpose. The loan was chargeable to interest @11.20% per annum with half-yearly rests. On 06.11.2021, at the request of the defendant, bank granted a loan of ₹5.00 Lacs in the form of Kisan Overdraft Limit for agricultural purpose. The loan was chargeable to interest @10.55% per annum with half-yearly rests. To secure the loan facilities, Defendant had mortgaged his agricultural land and standing crops (fully detailed in para No.3A of the application). Defendant had duly acknowledged his

liability towards the debt on 21.07.2023 and 15.02.2024. On 31.03.2025, a sum of ₹28,28,080.10p was due from the defendant. Despite repeated requests, defendant did not make the repayment. Hence, this application.

On 18.06.2025, summons was sent to the defendant by registered post, which was duly served. However, defendant did not put in appearance. Vide order dated 30.10.2025, he was proceeded ex parte .

In order to prove its case, the Bank has placed on record the affidavit of Sh. Adarsh Sharma, Authorized Officer along with the loan and security documents and marked them as Exhibit A-1 to A-15.

I have perused the evidence on the record. Sh. Kavan Singh, Officer is present with the original documents which have been perused by me. The same have been returned to him after perusal. I am of the considered view that the Bank has proved its case that it had advanced total loan of ₹20.00 Lacs and on 31.03.2025, total sum of ₹28,28,080.10p was due.

Accordingly, the application of the bank for the recovery of ₹28,28,080.10p (Rupees Twenty Eight Lacs Twenty Eight Thousand Eighty and Paise Ten Only) ₹21,04,089.86p in K.C.C. Limit with interest @11.20% p.a.; ₹7,23,990.24p in Kisan Overdraft Limit with interest @10.55% p.a. (both facilities) with half-yearly rests from 04.06.2025, till the date of payment is hereby allowed with costs. Bank can recover its dues by the sale of mortgaged land and standing crops fully detailed in para No.3A of the application as well as from the personal movable and immovable property(ies) of the defendant.

Recovery Certificate be issued accordingly.

Party is directed to appear before Recovery Officer on 01.09.2026, who is directed to distribute the sale proceeds of the mortgaged land and standing crops as per the provisions of Section 19(20-AB) of the Act . 10.
