The Applicant Bank examined Akash Ghosh, Legal Manager as AW-1 and marked 10 documents through him as Ex. A.1 to Ex. A.10.

Heard the Ld. counser for the Appricant Bank and perused the material placed on record.

The point that arises for consideration is:_

Whether the Applicant Bank is entitted for the claim made in the OA against the Defendant?

As stated supra, the Defendant remained ex_parte. The Evidence Affidavit coupred with the recitars in the documents viz., Exs. A.1 to A'10 marked on beharf of the Appricant Bank crinches the craim of the Appricant Bank against the Defendant. Hence, I hord that the Defendant is liable to pay the OA claim to the Applicant Bank wifh future interest and costs.

In the result, the present Original Application No.79Bl2025 is allowed as under: -

i) The Defendant is liable to pay to the Applicant Bank a sum of Rs.22,77,619. 16ps with future interest @13% p a. simpre, from the date of apprication til the date of rea lization ;

ii) the applicant bank is also entitled to proceed against the person and properties of the defendant for rea lization of its dues;
