Sh. Sandeep Kumar, Authorized Signatory of the applicant, who is competent to institute the Original Application vide Power of Attorney dated 16.09.2021, which is Annexure A1 to this OA. 2. The brief facts of the OA are that the defendant No.1 through its proprietor defendant No.2 approached the applicant for grant of Cash Credit Limit Rs.1.45 Crores & Term Loan of Rs.25.00 Lacs Defendant no. 3 stood as guarantor. Thereafter, defendant No.1 its proprietor defendant No.2 approached the applicant for enhancement of the limit to Rs.1.70 Crore. 3. The applicant sanctioned Cash Credit Limit Rs.1.45 Crores & Term Loan of Rs.25.00 Lacs vide sanction letters dated 16.12.2021, which are Annexures A3 & A4 to this OA and terms and conditions were duly accepted by the defendants. Thereafter, the limit was enhanced by the applicant to Rs.1.70 Crore vide sanction letter dated 23.08.2022, which is Annexure A17 to this OA. 4. Defendant no. 1 through its proprietor defendant no. 2 hypothecated stocks vide Deed of Hypothecation dated 27.12.2021 and 19.09.2022, which are Annexures A8 and A21 to this OA. Defendant no. 3 mortgaged his immovable property i.e. Land measuring 4Marla-6Sarsai, situated at Village Ransinh Kalan, Tehsil Nihal Singh Wala, District Moga, Punjab through equitable mortgage of transfer deed bearing vasika no. 950 dated 17.10.2017. Declaration Cum Confirmation Deed of mortgage dated 03.02.2022, which is Annexure A15 to this OA; Memorandum of entry dated 10.02.2022, which is Annexure A16 to this OA; Declaration Cum Deed of Confirmation for extension of mortgage, which is Annexure A23 to this OA; Memorandum of entry dated 17.09.2022, which is Annexure A24 to this OA.
