Advocate for the Applicant submits that the matter has been amicably settled with the Defendants for a sum of Rs.44,00,000/- and no due certificate is also issued. Now, the Applicant does not wish to proceed with this O.A. Hence, seeks for withdrawal of the present O.A. In view of the above submissions, the withdrawal of I.A. No.1227 of 2026 is allowed. Resultantly, O.A. No.755 of 2024 stands disposed of as withdrawn. Pending IAs, if any, stands disposed of. The Applicant shall be entitled to refund of court fees as per Rules. |
