The Applicant Bank filed the^present OA for the^recovery a^total sum of Rs.1,10,19,686.52ps i.e., a sum of Rs.79,14,804.47ps towards Credit Facility A/c. No.110420870000049 with^interest @10.10%^p.a., a sum of^{Rs.10,58,461.56pstowardsCredit} Facility A/c. No.1104201800000047 with interest @8.050/o^p.a. and a sum of Rs.20,46,420.49ps towards Credit Facility A/c. No.1104201800000046 with interest @8.90%^p.a. from the defendants^jointly and severally with^penal interest @2olo^p.a. from the date of application till the date of realization along with costs and in default for sale of OA schedule^properties.

Summons served on D1 to 3. They were set ex-parte on 31.o7.2026 as called absent and no representation.

The Applicant Bank examined Komara Shiva, Law Manager, as AW-1 and matked 27 documents through him as Ex. A.1 to Ex. A.27 .

Heard the Ld. Counsel for the Applicant Bank. Perused the material^placed on record.

The point that arises for consideration is:-

Whether the Applicant Bank is entitled for the claim made in the OA against the Defendants and OA schedule properties?

As stated supra, the Defendants remained ex-parte. The Evidence Affidavit coupled wlth the recitals in the documents viz., Exs. A.1 to A.27 marked on behalf of the Applicant Bank clinches the claim of the Applicant Bank against the^Defendants.

Hence, I hold that the Defendants are jointly and severally liable to pay the OA claim to the Applicant Bank with future interest and costs.

In the result, the present Original Apptication No.637/2O26 is allowed as under: -

i) The Defendants are jointly and severally liable to pay to the Applicant Bank a total sum of Rs.1,10,19,686.52ps i.e., a sum of Rs.79,74,8O4.47ps towards Credit Facility A/c. No.110420870000049, a sum of Rs.10,58,461.56ps towards Credit Facility A/c. No.110420I800000047 and a sum of Rs.20 ,46,42O .49ps towards Credit Facility A/c.No.1104201800000046; with future interest @8.90% p.a. simple from the date of application till the date of realization;

ii) the OA claim is secured by way of mortgage of properties described in the schedule annexed to the OA and the applicant bank is entitled to proceed against the same to realise its debt;

iii) the applicant bank is also entitled to proceed against the person and properties of defendants for realization of its dues;

iv) the applicant bank is entitled for the costs.
