The Applicant Bank filed the present OA for the recovery a total sum of Rs.2,64,77,741.78ps i,e., a sum of Rs.1,46,99,486.90ps towards e-DFS A/c.No.35852615993 with future interest @9.75o/o^p.d., o sum of Rs.39,09,427.43ps towards WCTL A/c.No.42L28134653 with future interest @9.25olo p.a, and a sum of Rs.78,68,828.45ps towards GECL A/c.No.40590027043 with future interest @9.25olo p.a. from the defendants jointly and severally with monthly rests from 28.05.2025 till the date of realization along with costs and in default for sale of OA schedule properties.

The Applicant Bank examined K. Sudhakar, Legal Manager, as AW-1 and marked 28 documents through him as Ex. A.1 to Ex. A.28.

Heard the Ld. Counsel for the Applicant Bank. perused the material placed on record.

The point that arises for consideration is:-

Whether the Applicant Bank is entiiled for the claim made in the OA against the Defendants and OA schedule properties?

As stated supra, the Defendants remained ex-parte. The Evidence Affidavit coupled with the "otiffi^documents

viz., Exs. A.1 to A.28 marked on behalf of the Applicant Bank clinches the claim of the Applicant Bank against the Defendants. Hence, I hold that the Defendants are jointly and severally liable to pay the OA claim to the Applicant Bank with future interest and costs.

In the result, the present Original Application No.57412025 is allowed as under: -

,i) The Defendants are jointly and severally liable to pay to the Applicant Bank a total sum of Rs.2,64,77,74t.78ps i.e., a sum of Rs.1,46,99,486.90ps towards e-DFS A/c. No.35852615993, a sum of Rs.39,09,427.43ps towards WCTL A/c. No. 42128L34653 and a sum of Rs.78,68,828.45ps towards GECL A/c. No. 40590027043; with future interest @9.15olo p.a. simple from the date of application till the date of realization;

ii) the OA claim is secured by way of mortgage of properties described in the schedule annexed to the OA and the applicant bank is entitled to proceed against the same to realise its debt;

iii) the applicant bank is also entitled to proceed against the person and properties of defendants for realization of its dues;
