This original application has been filed by the applicant bank, on 03.09 .2022 through Shri. Ranjeet Jha, Authorized Representative of the applicant bank, under Section 19 of the RDB Act, 1993 against the sole defendant for recovery of a sum of Rs.38 ,L8,72L.61 together with cost, charges and pendentellite and future interest @19.00^o/ofrom date of filing of this O.A. till the realization in full.

The brief facts of the case are that at the request of sole defendant, the applicant bank sanctioned Overdraft Facility of Rs.10,00,000/-. The defendant had entered into a request letter and also the terms and conditions of the over limit on 27.08.2007 and the said facility was valid for one year and the facility renewed from time to time by viftue of the auto renewal clause. documents on^{27.08.2007. Again, at the request of} sole defendant, the^{applicant bank renewed the} overdraft facility^{with enhancing the limit of} Rs.25,00,000/- and^{issued the renewal of credit} arrangement^{letter and amendmentto the facility. The} renewal of credit^{arrangement letter dated 22.08.2008} was executed by the^{sole defendant.}

It is further^{submittedthat the sole defendant} enjoyed and^{utilized the Loan facilities, but failed to} maintain the^{financial discipline and failed to repay the} due amounts.^{The applicantbank requested the sole} defendant to^{regularizethe loan account by visits and} letters, but there^{was no responsefrom the sole} defendant.^{The applicantbank serued a recall dated} 06.01 .Z:OZL to^{the sole defendant but failed to recover} the same. Thus,^{the present o.A. is preferred by the} applicant^{bank to recover its dues.}

The^{applicant bank has filed evidenceby way of} affidavit of sh.^{Balram Kumar, Authorized} Representative^{of the applicant bank as Annexure-Ato} Annexure-F,^{which have gone unchallenged and un-} rebutted.^{Hence, the case of the applicant stands fully} established^{againstthe sole defendant with respect to} nonpayment^{of outstanding amount'}

After perusing the records, this Tribunal is of the view that the applicant bank has proved its case beyond reasonable doubts. The evidence and documents filed by the applicant bank not rebutted by the sole defendant by not placing any evidence and there is no question of disbelieving the evidence and documents filed by the applicant bank based upon the written/pri nted docu ments.

In the light of the above discussions, the present O.A. deserues to be allowed.

I hereby allow this O.A. of the applicant bank and direct the sole defendant to pay to the applicant bank within 30 days from today, a sum of Rs.38,L8,72L.6L along with cost, expenses and interest @17.5olo from the date of filing of this O.A. till the date of realization.

In case of failure to deposit the above amount within the stipulated period, the same shall be recovered from the sale of personal movable and immovable assets of the sole defendant.

Recovery Ceftlficate be issued forthwith and be sent to Recovery Officer, Debts Recovery Tribunal-Il, Delhi.

The registry of thls Tribunal is hereby directed to issue free copy of the order and send the same to both the parties.
