The Applicant Bank filed the present OA for the recovery a total sum of Rs.60,58,810/- i.e., a sum of Rs.36,56,933/- towards Home Loan (IBHL) A/c. No.6999295153 with future interest @8.55olo^p.a., a sum ot Rs.5,48,227/- towards HL Improve A/c. No.7084649923 with future interest @9.65010 p.a., a sum of Rs.s,44,416/- towards IND Kavach A/c. No.7158342343 with future interest @9.90olo p.a. and a sum of Rs.13,09,234ltowards Mudra Loan A/c. No.7001043158 with future interest @L2.45o/o^p.a. from the defendants jointly and severally with monthly rests from the date of application till the date of realization along with costs and in default for sale of OA schedule property.

The point that arises for consideration is:-

As stated supra, the Defendants remained ex-parte. The Evidence Affidavit coupled with the recitals in the documents viz., Exs. A.1 to A.49 marked on behalf of the Applicant Bank clinches the claim of the Applicant Bank against the Defendants. Hence, I hold that the Defendants are^jointly and severally liable to^pay the OA claim to the Applicant Bank with future interest and costs.

In the result, the present Original Application No.56/2026 is allowed as under: -

i) The Defendants are jointly and severally liable to pay to the Applicant Bank a total sum of Rs.60,58,810/- i.e.. a sum of Rs.36,56,933/- towards Home Loan (IBHL) A/c. No.6999295153, a sum of Rs.s,4a,227/towards HL Improve A/c. No.7084649923, a sum of Rs.5,44,416/- towards IND Kavach A/c.No.7158342343 and a sum of Rs.13,09,234l- towards Mudra Loan A/c. No.7001043158; with future interest @7.L5o/o^p.a. simple from the date of application till the date of realization;

ii) the OA claim is secured by way of mortgage of property described in the schedule annexed to the OA and the applicant bank is entitled to proceed against the same to .V
